"Customer" or "you" means the person or company who place an order via the website to purchase any of the products. "Products" means the products offered for sale by The Gift Experience via the website. "the Website" means "thegiftexperience.co.uk" ACCEPTANCE OF ORDER:Placing an order through the website is notification that you agree with our terms and conditions. These terms and conditions will be updated occasionally, please check them before making your purchase. 1. GENERAL1.1 These terms and conditions are applicable to the supply of all Products by The Gift Experience, to the Customer. All other terms and conditions, expressed or implied by statute or otherwise, are excluded to the fullest extent permitted by law. 1.2 We have made every effort to display all our products as accurately as possible. However as colours and images vary depending on your own monitor and browser we cannot guarantee that products will be exactly as seen on your monitor. Most products have been described with sizes/lengths given as accurately as possible. 2. PRICE2.1 All prices are quoted in £ Sterling. 2.2 All prices are exclusive of postage and packaging, unless otherwise stated. You will be given the total price of the transaction before you complete your purchase. There are no hidden extra costs. 2.3 In the rare event that an item is incorrectly priced on the web site, The Gift Experience reserves the right to not supply that item at said price. The normal price will be offered instead. 3. PAYMENT3.1 Payments must be made in £ Sterling only. You can use Visa, MasterCard, Switch, Solo, Delta, EuroCard, JCB, Laser, Electron. When you have completed your selections you are automatically transferred to the World Pay secure server. 3.2 As soon as the transaction is confirmed thegiftexperience.co.uk receives an authorisation code. 3.3 The secure server is acknowledged as an industry standard for applications requiring a high degree of security. 3.4 After placing an order the Customer will receive an e-mail confirmation of order for the purchase. 4. PASSING OF PROPERTY4.1 The Gift Experience shall retain legal title to the products until all payment has been made in full by the Customer. 5. PASSING OF RISK5.1 The risk on the Products shall pass to the Customer upon delivery. 6. DELIVERY6.1 Any date or period for delivery shall be considered as indicative only, although if a product is in stock, we aim to send it out on your behalf to your specified delivery address within the timescale specified against each product. If any item is not in stock we will aim to deliver within 14 days, but 28 days should be allowed. If we cannot despatch an item to you within the specified time we will notify you and at your request we will cancel the order and refund your money in full. 6.2 Once the item(s) have been delivered to the delivery address it is no longer the responsibility of The Gift Experience. Refunds cannot be given if your gift is not passed on to the main recipient. 6.3 The Gift Experience will not be held responsible for delays in the delivery caused by the manufacturer, or any other third party. 7. ACCEPTANCE7.1 The Customer shall inspect the goods within a reasonable time after their receipt. (This does not however affect the customer's statutory rights). 8. GUARANTEE REFUNDS AND RETURNED GOODS8.1 No refunds/exchanges are available on earrings or body jewellery for hygenic reasons or rings ordered to a specific size. 8.2 We offer a simple 7 Day Money Back Guarantee. If any item is not what you required then just notify us by email/post (stating reason for return) within 7 days of receipt. We will then issue you with either a refund or allow you to exchange the item for something else instead. When refunding the customer, postage costs on the original order are not refunded. 8.3 Please send items back via recorded delivery for your own proof of delivery. This postage cost is not reimbursed (unless item is damaged/faulty). 8.4 Please check your goods on delivery. If items do arrive damaged/faulty please let us know within 3 days and arrange to post them back to us via recorded delivery. We will reimburse you these extra postage costs. If you do not inform us within 3 days, then we will have no liability for items said to be damaged/faulty on delivery. 8.5 Please address any returned Products to: The Gift Experience Ltd, Unit 1 Mereside Offices, Mereside Industrial Estate, Fenns Bank, Near Whitchurch SY13 3PA 9. CANCELLATION9.1 The Gift Experience reserves the right to refuse any order or part of order or to require further or better information to enable it to evaluate or process the order. 9.2 The Gift Experience accepts no liability for any failure to ship products where this results from its’ inability to do so or its’ decision on reasonable grounds not to do so, provided it takes all reasonable steps to notify the customer within 14 days of order placement that products will not be shipped as ordered. In such cases The Gift Experience will immediately refund any payments made in full. 9.3 The consumer has the right to cancel their order within 7 working days which starts from the day after the day the customer receives the goods. The customer will have to pay the cost of returning the goods. The Gift Experience will refund the customer’s money within 30 days of cancellation. 10. LICENCE AGREEMENT10.1 The Customer shall respect all license agreements delivered by the copyright owners. The Gift Experience cannot be held responsible for any misuse constructed by the Customer or any third party. 11. DISPUTE RESOLUTION11.1 If the Customer has any complaint he or she should contact The Gift Experience on 01948 780765 or email the complaint to enquiries@thegiftexperience.co.uk. The Gift Experience agrees to respond promptly to all complaints in a fair and equitable manner. 11.2 The Gift Experience and the Customer shall use their best efforts to negotiate in good faith and settle amicably any dispute that may arise out of the supply of Products or these Conditions. 11.3 If the parties cannot settle any such dispute within 21 days it shall be determined by an independent third party jointly nominated by the parties ("the third party"). If the parties shall fail to nominate a Third Party within a further 7 days then the Third Party shall be nominated at the request of either party. The consumer is not compelled to take part in these proceedings. 11.4 The Third Party shall act as an expert and not as an arbitrator whose decision (including as to costs) shall be final and binding upon the parties. 12. LAW12.1 These terms and conditions are governed and shall be interpreted in accordance with the laws of England and Wales. |
